La dogmática de los principios penales adolece de una reconstrucción normativa a partir de categorías estructurales. La propuesta de Atienza y Ruiz Manero sobre los enunciados jurídicos contiene un arsenal conceptual que resulta especialmente adecuado a la hora de realizar una taxonomía de los principios y límites penales. Esta reconstrucción resulta particularmente provechosa en el ámbito del control de constitucionalidad de las leyes penales, ya que, a partir del test de proporcionalidad, los derechos y bienes constitucionales son clasificados por (...) parte de la doctrina y de la jurisprudencia constitucional comparada como principios o reglas. In this paper I survey some recent developments in experimental philosophy and discuss their bearing on two leading theories in epistemology: Contextualism and Interest Relative Invariantism. In the first part of the paper, I survey some general issues of how experimental philosophy may be relevant to assessing contextualism and IRI. In the second part, I discuss and critique some of the recent experimental work.

The research project of common sense or folk behavior for the specific purposes of advancing epistemology has quickly become one of the largest in experimental philosophy. This chapter explains some of this work as it relates to two positions in epistemology: contextualism and interest relative invariantism (IRI). Naturally, questions arise about the relevance of folk behavior to debates in epistemology. First, there is the dialectical issue concerning the extent to which epistemologists have in fact relied on ordinary behavior in defending (...) their theories. Second, in the cases where epistemologists have made such appeals, people can ask if they have been correct in doing so. And third, assuming correctness in this regard, there is a question about which experimental methods, if any, are pertinent for understanding folk behavior. This study investigates the relationship between mental health and emotional intelligence among senior high school students in a public school. Thus, the study employed a correlational design to measure the relationship between mental health and emotional intelligence among 152 Grade 12 senior high school students in a public school. Hence, to measure the study’s variables - Mental Health Inventory and Emotional Intelligence Scale (EIS) were utilized. Based on the inferential statistics, the r coefficient of 0.32 indicates a low positive correlation (...) between the variables and a p-value of 0.00, indicating a significant relationship between the respondents' mental health and emotional intelligence. Individuals and businesses make numerous payments every day. They sometimes have choices about what forms of payment to make or accept, and at other times are effectively forced to use a particular form. Often there is an asymmetric power relationship between payer and payee that raises the issue of whether one side unfairly exploits the other. Is it unethical exploitation for an employer to pay employees with a fee-laden payroll card over other more convenient forms of payment? Does the fee (...) structure of payment networks such as Visa and MasterCard unfairly exploit merchants? The bitcoin payment system is an ethical as well as technological evolution as it was designed to be an electronic payment system that does not rely upon trust. Can an entire payment system like bitcoin be “evil,” as charged by Krugman? Payment tools as such are ethically neutral, but can be used in an ethical or unethical manner. (shrink)

Brand names constitute a form of value for commercial products, because they suppose a savings of search costs for the consumer. The law, as a consequence, has the obligation to protect brand names. But the number of attractive brand names is not infinite and sometimes companies seek brand names which are reminiscent of others. In this article a conflict between two companies for the distinctiveness of two brand names is addressed: one Spanish company used the English common noun doughnut for (...) a product similar to the American pastry, while the other company had already registered donut as a brand name, in addition to its variants. This second company sued the first on the grounds that the names were not distinctive. Here we offer the arguments presented to the judge in defense of the distinctiveness of doughnut and the judgment. (shrink)

This article reviews the research of “top rebirth scientist” Ian Stevenson on spontaneous past-life memory cases, focusing on three key problems with Stevenson’s work. First, his research of entirely anecdotal case reports contains a number of errors and omissions. Second, like other reincarnation researchers, Stevenson has done no controlled experimental work on such cases; yet only such research could ever resolve whether the correspondences found between a child’s statements and a deceased person’s life exceed what we might find by chance. Recently there has been an outpouring of consumer frustration over rising food and energy prices. Many politicians railed against “speculators” who allegedly drove up the prices of key necessities. Is speculation unethical? This article reviews the traditional arguments against speculation. Many of the standard criticisms confuse speculation with gambling. In much the same way as ethicists now draw distinctions between usury and normal business interest, we draw a distinction between socially useful speculation and gambling. Gambling involves taking on risk with (...) no plausible expectation of making a profit. Gambling may provide entertainment value to some people, but like other addictive activities causes grave harm to a subset of users. Speculation involves taking on a business risk with a plausible expectation that a profit will result. Speculators provide an important risk bearing service by taking on risks that others do not want. They help markets to function better by helping to incorporate information into prices as well as providing liquidity. Speculators may actually reduce shortages by causing quicker price increases that motivate producers to increase production and consumers to conserve. But even socially useful speculation may have an ethical dark side. Does such speculation cause damage by adding excess volatility to prices? Speculators may contribute to price bubbles. At what point does legitimate speculation become odious “price gouging?” We also draw an ethical distinction between speculation, which seeks to benefit from changing prices, and manipulation, actions taken to push prices away from their economically appropriate levels. Low‐back pain can be invalidating physically as well as mentally. Despite professional help to treat and prevent low‐back pain, the pain often persists, and so do the problems related to low‐back pain. An intervention that made it possible for a significant part of patients with low‐back pain to improve health and well‐being raised the question: Why was it possible to help some and not others? The aim of the present paper was to achieve a deeper understanding of factors patients experienced (...) as helpful in professional support related to low‐back pain. This was explored using a hermeneutic‐phenomenological approach while analysing 20 interviews with patients with low‐back pain purposively chosen interviews conducted in relation to the intervention. An analysis was made using Ricoeur's interpretation theory. Data on both positive and negative experiences were read and reflected upon. We found that healthcare professionals’ adoption of a narrative approach facilitating the patient's perspective was perceived as helpful. Patients experienced this as being taken seriously; an experience that could be explained at a deeper, more nuanced level using Heidegger's philosophy. Facilitating the patient's perspective was conditional not only on the professional obtaining access to the patient's perspective but also on understanding and acknowledging the patient's existence. The challenge for healthcare professionals in this respect is to bridge the gap between the consultation's fact‐focused concern with the medical implications of low‐back pain and the patient's concern with the implications low‐back pain has for his or her personal identity and life. Listening to the patient's perspective in itself supports the subjective recovery process, while also supporting the quality of patient‐centred support and strengthening the patient's trust in its helpfulness. This volume answers the question: Why do we believe what we believe? It examines current research on the concept of beliefs, and the development in our understanding of the process of believing. It takes into account empirical findings in the field of neuroscience regarding the processes that underlie beliefs, and discusses the notion that beyond the interactive exploratory analysis of sensory information from the complex outside world, humans engage in an evaluative analysis by which they attribute personal meaning and relevance (...) to the probabilistic representations of objects and events. Beliefs exert a strong influence on behaviour, decision-making, and identifying and solving problems. Despite their importance, beliefs have until recently not been at the centre of scientific interest. In fact, "belief" is an ill-defined phenomenon. From a transdisciplinary perspective the actual approaches to understanding belief seem incompatible as they attempt to highlight such different topics as "belief - religion", "belief - spirituality", "belief - faith", "belief - knowledge", "belief - attitude", "belief - disbelief", "belief - illusion", and "believing - brain function". This situation contradicts the idea that belief is close to pathological phenomena and that it should be eliminated from scientific discussions. Rather, believing is fundamental for understanding the many problems of every-day life. In fact, the book shows that beliefs are relevant for politics, international affairs, economy, law, or religions also in modern societies. This book presents the increasing scientific interest in beliefs and believing, and reflects the change in focus from the content aspect of belief towards the fluid nature of believing. (shrink)

En este artículo el autor realiza una interpretación del libro Sobre el gobierno tiránico del papa del filósofo medieval Guillermo de Ockham. En la exposición se ofrecen argumentos para justificar varias tesis: la primera, desmontar el prejuicio de que la ilustración moderna abandonó o canceló los contenidos y el procedimiento hermenéutico del pensamiento medieval. La segunda consiste en postular que en el libro citado se encuentran las raíces filosóficas de algunos conceptos centrales del pensamiento político y moral del liberalismo moderno (...) y la tercera tesis apunta a mostrar el modo como el pensamiento político de Guillermo de Ockham anticipa o diseña los rasgos esenciales del moderno concepto de opinión pública o razón pública, tan central hoy en los debates de la teoría y la filosofía política. En la a exposición de estas tres cuestiones se articula, finalmente, una reflexión sobre el papel del filósofo como mediadorintérprete entre el poder formal y la potencia informal de los intereses comunes de los individuos, elementos sobre los que bascula el sentido político poder. The aim of this work is to analyse the concept of semi-sentence from a linguistic, formal and computational point of view. A semi-sentence can be characterised as a sentence which, from a grammatical perspective, is neither absolutely correct nor incorrect . This study focuses on: - a characterisation of the semi-sentences in the setting of the grammar of a language. This study will help to analyse in depth the concept of grammaticality [3]; - the correlate of semi-sentences in formal languages, (...) i.e., semi-strings, which arise from applying productions that deviate from that which is strictly permitted by the rules of grammar [6]; - a Prolog program for handling semi-grammaticality in a computational manner [2]. Resumo: Abordamos a interpretação nietzschiana sobre “liberdade” e “necessidade” e como o filósofo contesta noções da tradição, vinculadas a essa problemática: “causa e efeito”, “sujeito”, “vontade”, etc. Ele assinala como esses conceitos seriam construtos antropomórficos que não conseguem desvendar as ações geridas apenas pela dinâmica da vontade de potência. Mostramos que Nietzsche, mesmo com sua crítica aos conceitos da tradição, continua empregando noções como “fatalidade”, “necessidade”, que parecem reeditar uma conceituação antropomórfica. Indicamos como ele ultrapassa objeções passíveis de serem feitas (...) a um pensamento oscilante, que parece negar e afirmar a liberdade. Concordamos com intérpretes que destacam como seu estilo suscita deliberadamente paradoxos e aporias, já que seu objetivo, antes que estabelecer uma doutrina ou uma teoria consolidada, visa instigar novas reflexões e experiências de pensamento sobre o agir do homem.: We address nietzschiana interpretation on the issue of freedom and necessity. We show how the German philosopher disputes notions of philosophical tradition, linked to this problem, as “cause and effect”, “subject”, “i”, “will” etc. He points how these concepts would be just anthropomorphic constructs that cannot unravel the nature of the actions; managed only by the power control game of the will of power. We show that Nietzsche, even with this radical criticism of the concepts of tradition, continues to employ notions such as “fatality”, “necessity” that seem to resend to the anthropomorphic conceptualization questioned. We indicate how the author of Zaratustra manages to overcome the objections that may be made to an oscillating thought, which sometimes seems to deny and affirm freedom at different times of his work. We agree with interpreters who point out that Nietzsche’s style deliberately chooses to raise paradoxes and apparent apores, since his goal, before establishing a doctrine or a consolidated theory about freedom and necessity, is an attempt to instigate new reflections, new thought experiences, new paths of meditation on the action of man. El objetivo consiste en explicar el contexto del problema del acabamiento de la metafísica del idealismo alemán, para analizar la posición que tiene Heidegger de las nociones de diferencia y voluntad forjadas por la filosofía tardía de Schelling; de esta manera, a partir del abismo de la voluntad se muestra la intersección entre la filosofía de la libertad de Schelling (...) y la ontología del evento de Heidegger. La intervención de la ciudad con fines artístico-creativos en manos de colectivos o anónimos transeúntes, es una práctica cada vez más habitual en el espacio urbano. Esta pluralidad de manifestaciones, tanto icónicas como verbales, suscita ciertas controversias a la hora de nominarlas, sobre todo por tratarse de “obras” proscritas en su mayoría, por lo que su estatus artístico o literario es, a veces, discutible. A partir de la delimitación de la estructura de necesidades de algunas expresiones artísticas, en este trabajo (...) proponemos una taxonomía, basada en la lógica analógica de Jean-Marie Schaeffer, de las manifestaciones murales de tipo lúdico-textual inscritas en la ciudad. Para ello, tomamos como referentes a tres representantes vigentes de lo que llamaremos aquí, pintadas poéticas. Con este trabajo trabajo buscamos contribuir a esclarecer la ambigüedad conceptual que existe en torno a la noción de pintadas poéticas, y a revitalizar la discusión sobre el espacio urbano, el espacio virtual, la subversión y la institución artística. Mostraremos seguidamente la idea que tiene sobre la paciencia el paradigma clásico de San Agustín y Santo Tomás para valorar la peculiaridad del pensamiento de Kierkegaard. Explicaremos, en tercer lugar, las características de la paciencia en relación con el tiempo, el bien, el sufrimiento, la libertad y Dios en el pensador danés. First of all, we will deal with the fundamental texts where Kierkegaard analyses it. We will then show the idea that the classical paradigm of St. Augustine and St. Thomas has about patience in order to assess the peculiarity of Kierkegaard's thought. Thirdly, we will explain the characteristics of patience in relation to time, good, suffering, freedom and God in the Danish thinker. I consider here the issue of whether and to what extent moral truths are absolute. My aim is to raise some new considerations in favor of moral relativism: the thesis that some moral statements can vary in truth-value depending on the moral standards at issue.1 2 This paper has three major components. This paper examines the ethics of contemporary managerial compensation in the context of executive stock options. Economic considerations would dictate that executive stock options should be adjusted to eliminate the effect of overall stock market movements which are beyond the control of the executive. However, in practice, most executive stock options are not adjusted to control for these outside factors. Agency considerations are the most likely culprit. Adjusting for the influence of outside factors, such as a generally rising stock market, (...) from executive stock options sets a higher bar for managers to reach. Furthermore, traditional accounting standards permitted firms that did not adjust options to avoid reporting options as expenses. This presents CEOs and boards of directors with a major ethical dilemma. On the one hand, their duty to their shareholders and stakeholders dictates that executive stock options should be adjusted to eliminate outside noise from unrelated movements in the overall stock market. However, financial statements are presented in the language of accounting. If the overwhelming majority of the users of a language define a particular item in one way, then to deviate from the norm implies that the recipient of such a deviant statement may not properly interpret the statement. Likewise, if the standard practice is for firms to use unadjusted options and thus under-report expenses, to deviate from this industry norm risks that users of financial statements would not properly interpret the financial statements, with perhaps negative consequences for the shareholders. In short, if "everyone else does it," then it could be wrong for an individual firm to deviate from the norm as that would harm the shareholders. (shrink)

Es indudable que el inconsciente colectivo estudiado por Jung y su escuela psicoanalítica, nos ha demostrado fehacientemente que las conductas observadas y aprendidas en la infancia tanto en la familia como en la sociedad, se reproducen de manera muy similar en las generaciones jóvenes.

En este contexto interesa preguntarse por la significación y la utilidad que puede tener hoy una conversación con los escritos de Wittgenstein. No es una pregunta que deba interesar sólo a los especialistas, sean filósofos profesionales o de otros campos científicos, sino que es una pregunta que toca los intereses de las personas en cualquiera de los ámbitos de la acción. En el contexto del giro hermenéutico en el pensamiento de Wittgenstein me propongo destacar algunos puntos que pueden dar lugar (...) a un diálogo más amplio entre el pensamiento de Wittgenstein y la hermenéutica filosófica contemporánea, tales como la relación entre los conceptos de ethos o forma de vida, logos, juego, sentido común y cotidianidad. The term theodicy was coined by the philosopher Gottfried Wilhelm Leibniz (1646-1716) and is inherent in the question of how evil can exist if an intrinsically good God guides everything. The publication of this oeuvre initiated intense philosophical and theological discourse in the subsequent centuries, during which many issues that bare upon human well-being were articulated. Also, Leibniz’s rational approach to the relationship between God and evil raised a number of issues related to the topic of belief. This topic has (...) entangled discourses on theodicy with a long-lasting debate on beliefs, which goes back to Antiquity. Recently, a paradigm-shift shed new light on the understanding of belief. Science has begun to address the neurophysiological mechanisms of the processes that underpin belief formation, modulation, and change. The term credition was coined in order to capture and reflect this new and innovative understanding of the fluidity of beliefs and believing. This paper presents various features of a pattern of interrelationships between well-being, theodicy, and credition. (shrink)
